La position de la FRBTP de Guyane dans cette situation sanitaire

Depuis plusieurs semaines, l’épidémie de Covid-19 met à mal la situation sanitaire et économique de notre nation. Ainsi le 16 mars dernier, à l’occasion de son allocution présidentielle, Emmanuel Macron déclarait : « nous sommes en guerre ».

Depuis, le gouvernement a pris nombre de mesures exceptionnelles, au rang desquelles des consignes drastiques de confinement visant à contraindre le risque pandémique, accompagnées elles-mêmes de dispositifs de soutien économique aux entreprises impactées.

« En même temps », le chef de l’Etat encourageait la continuité de l’activité économique, dans les secteurs dits essentiels à la vie économique du pays ; dernier point sur lequel le BTP est sur la ligne de front.

SECURITE SANITAIRE ET ACTIVITE ECONOMIQUE
Dans les faits, si nous entendons prendre notre pleine part à « l’effort de guerre », en satisfaisant aux injonctions répétées du gouvernement visant à maintenir la continuité de l’activité économique, nous ne saurons lui sacrifier la sécurité sanitaire des hommes et des femmes qui font la vie de nos entreprises.

Dans nos métiers et de tous temps, la santé de nos compagnons est une priorité cardinale, et à l’évidence nous subissons une crise sanitaire sans précédent, qui en désorganisant sensiblement notre profession, nous oblige à revoir l’ensemble des modalités de nos interventions sur chantiers.

C’est en substance le sens des positions prises dès le 18 mars par nos fédérations de tutelle (FFB et FNTP), lesquelles faisant communiqué de presse commun avec la CAPEB, interpellaient l’Etat sur l’absolue nécessité, de disposer d’un temps minimal pour procéder aux réorganisations et ajustements pratiques autorisant une poursuite de l’activité, tout en garantissant à la fois la sécurité sanitaire de nos compagnons, et la sécurité juridique de nos chefs d’entreprise.

POSITION DE LA FEDERATION LOCALE
Depuis 2015, les entreprises guyanaises du BTP payent un lourd tribu aux crises successives ; les blocages de mars-avril 2017 n’ayant fait qu’aggraver une situation économique déjà lourdement fragilisée par un choc systémique sans précédent.

Dans ce contexte, notre fédération tient une position claire et suffisamment nuancée pour permettre à chaque chef d’entreprise, en fonction des caractéristiques et spécificités de son activité, et des moyens dont il dispose, d’apprécier en responsabilité, toute décision de maintien, de réduction ou de suspension d’activité, avec pour mot d’ordre cette position invariable : « LA SANTE DES SALARIES D’ABORD ! »

VIGILANCES ET PRECONISATIONS
PROTOCOLE SANITAIRE OPPBTP :
Afin d’assurer la sécurité juridique de nos entreprises, nous sommes dans l’attente de consignes sanitaires claires émanant de ce protocole. Pour l’heure, les activités urgentes et vitales pour la population se poursuivent (maintenances et réparations urgentes, mises en sécurité des réseaux, entretiens indispensables...). S’agissant des autres travaux, la production se déroulera inévitablement en mode dégradé, aussi longtemps qu’un confinement strict est nécessaire du point de vue sanitaire.
ACTIVITE PARTIELLE :
Il est désormais acquis que les entreprises du BTP sont éligibles à l'activité partielle. Pour autant les conditions d'éligibilité et leur recevabilité restent incertaines, le traitement au "cas par cas", constituant le mode de traitement privilégié. Notre Fédération craint que cette dernière disposition soit de nature à entraîner très rapidement un effet de saturation des services de la DGCOPOP, sans un renforcement des moyens humains dédiés au traitement de ces demandes.
CONGES PAYES :
L’ordonnance n°2020-323 impactera les dispositions légales relatives aux congés payés. Ce sujet, s’il n’est pas abordé collégialement dans le cadre du dialogue social, pourrait constituer une pierre d’achoppement en cas de prolongement de la période de confinement. Aussi, nous souhaitons que Commission Mixte Paritaire animée par la DGCOPOP, se réunisse sans délai, pour nous permettre d’ entamer les négociations avec les partenaires sociaux visant à aboutir à un accord de branche.

CHAINE LOGISTIQUE :
Afin de maintenir la continuité de l’activité, il est indispensable que l’ensemble de la filière logistique s’organise pour répondre à nos besoins opérationnels (équipements et fournitures sanitaires, matériaux, matériels, décharges, centrales...)

DELAIS DE PAIEMENT :
Nous saluons généralement l’ensemble des mesures d‘accompagnement prises par les pouvoirs publics, Pour autant nous affirmons qu’une contraction significative des délais de paiement des factures émises, et le règlement en urgence des arriérés de créances, tel qu’indiqué dans les mesures fiscales annoncées par le gouvernement, contribueraient sensiblement au renforcement de la trésorerie de nos entreprises. S’il s’agit bien d’une action à mener individuellement, notre fédération attachera la plus grande vigilance au respect de ces engagements.

SOLIDARITE ECONOMIQUE :
En maintenant la continuité de leurs activités, les entreprises du BTP prennent leur pleine part à l’effort de solidarité, en supportant seules, les surcoûts liés aux réorganisations de l’ensemble des modalités d’ intervention sur chantier, et les pertes d’exploitation inhérentes à la poursuite d’une activité en mode dégradé. Il serait d’un juste équilibre que les acheteurs publics encouragent ce volontarisme solidaire par un rehaussement généralisé à 60% des avances de démarrage pour tous les nouveaux chantiers, conformément aux dispositions prévues à l’article R2191-8 du code de la commande publique.

HEALTH SECURITY AND ECONOMIC ACTIVITY
In fact, if we intend to take our full share in the "war effort", by complying with the government's repeated orders to maintain the continuity of economic activity, we cannot sacrifice the health security of men and women who make the life of our companies.

In our professions and at all times, the health of our companions is a cardinal priority, and obviously we are undergoing an unprecedented health crisis, which by significantly disrupting our profession, obliges us to review all the modalities of our interventions on construction sites.

This is essentially the meaning of the positions taken on March 18 by our supervisory federations (FFB and FNTP), which, making a joint press release with the CAPEB, challenged the State on the absolute necessity of having a minimum time to carry out reorganizations and practical adjustments authorizing a continuation of the activity, while guaranteeing at the same time the health security of our companions, and the legal security of our business leaders.

LOCATION OF THE LOCAL FEDERATION
Since 2015, Guyanese construction companies have paid a heavy price for successive crises; the bottlenecks of March-April 2017 only worsened an economic situation already severely weakened by an unprecedented systemic shock.

In this context, our federation holds a clear and sufficiently nuanced position to allow each business manager, depending on the characteristics and specifics of his activity, and the means at his disposal, to assess in responsibility, any decision to maintain, reduction or suspension of activity, with the watchword this unchanging position: "THE HEALTH OF EMPLOYEES FIRST! "

VIGILANCES AND RECOMMENDATIONS
OPPBTP HEALTH PROTOCOL:
In order to ensure the legal certainty of our companies, we are waiting for clear health instructions from this protocol. For the time being, urgent and vital activities for the population are continuing (urgent maintenance and repairs, securing of networks, essential maintenance, etc.). For other works, production will inevitably take place in degraded mode, as long as strict confinement is necessary from a health point of view.

PARTIAL ACTIVITY:
It is now understood that construction companies are eligible for partial activity. However, the conditions of eligibility and their admissibility remain uncertain, treatment on a "case by case" basis, constituting the preferred mode of treatment. Our Federation fears that this latter provision will very quickly lead to a saturation effect on the services of the DGCOPOP, without strengthening the human resources dedicated to processing these requests.

PAID VACATION :
Ordinance No. 2020-323 will impact the legal provisions relating to paid holidays. This subject, if it is not tackled collegially within the framework of social dialogue, could constitute a stumbling block in the event of an extension of the period of confinement. Also, we hope that the Joint Joint Commission, chaired by the DGCOPOP, will meet without delay, to allow us to start negotiations with the social partners aimed at reaching a sector agreement.

SUPPLY CHAIN :
In order to maintain business continuity, it is essential that the entire logistics chain is organized to meet our operational needs (equipment and supplies sanitary facilities, materials, materials, landfills, power plants, etc.)

PAYMENT PERIOD :
We generally welcome all the support measures taken by the public authorities. However, we affirm that a significant contraction in the payment terms for invoices issued, and the urgent settlement of arrears of debts, as indicated in the tax measures announced by the government, would significantly contribute to strengthening the cash flow of our businesses. If this is indeed an action to be carried out individually, our federation will pay the greatest vigilance to the respect of these commitments.

ECONOMIC SOLIDARITY:
By maintaining the continuity of their activities, construction companies take their full share in the solidarity effort, by supporting alone, the additional costs linked to the reorganizations of all the procedures for intervention on site, and the operating losses inherent in the pursuit of an activity in degraded mode. It would be a fair balance for public buyers to encourage this united voluntarism by a general increase to 60% in start-up advances for all new projects, in accordance with the provisions of article R2191-8 of the public procurement code.
