L'arrêté préfectoral de la mine d'or Nelson annulé

Ce jeudi 12 décembre, le Tribunal administratif de Cayenne a délibéré sur le fond du dossier Nelson. L’arrêté préfectoral autorisant la SAS TRAJAN à exploiter une mine artisanale sur l’amont du fleuve Kourou a été déclaré illégal. Les opérateurs touristiques, l’association amérindienne TE’LEYU et la fédération Guyane Nature Environnement sont satisfaits de voir aujourd’hui s’appliquer les lois environnementales après plus d’un an de bataille judiciaire.

Fin 2018, la SAS TRAJAN avait été autorisée à exploiter une mine d’or en amont du Kourou. Les opérateurs touristiques, l’association amérindienne TE’LEYU et la fédération Guyane Nature Environnement contestaient pourtant la légalité de cet acte pour non-respect de la réglementation environnementale. Les requérants ayant été déboutés sur le recours en urgence début 2019, la société minière avait pu mener à bien son exploitation.

Le jeudi 21 novembre 2019, les requérants ont pu s’exprimer sur le fond du dossier. D’une part, l’ONF, en tant que gestionnaire du foncier de l’Etat, avait donné un avis défavorable prenant en cause la sensibilité des milieux naturels concernés. D’autre part, la notice d’impact sur les milieux était nettement insuffisante vis-à-vis des enjeux. C’est ce qui a été retenu par le Tribunal administratif de Cayenne ce jeudi 12 décembre.

Le bassin du Kourou est un espace de vie riche en biodiversité. C’est aujourd’hui une vitrine écotouristique incompatible avec l’exploitation aurifère. La mine légale située en amont du fleuve fragilise quant à elle les écosystèmes amazoniens et ne peut se prévaloir des lois environnementales au même titre que toute autre activité économique. C’est ce nous confirme la décision d’aujourd’hui.

Pour Rémi GIRAULT, Président de Guyane Nature Environnement, « c’est une décision importante qui montre bien que ce dossier n’a pas été correctement instruit. Malheureusement, cette mine, qui a été exploitée pendant plusieurs mois, a engendré des impacts environnementaux irréversibles et aucune technique de revégétalisation ne permet de reconstituer la complexité d’une forêt ancienne ou d’un cours d’eau détruit. Les sols déstructurés seront encore longtemps soumis à l'érosion et continueront de polluer le Kourou. »

Bien que la mine n’a pas pu être stoppée à temps, les requérants sont satisfaits aujourd’hui de cette décision et espèrent que cette jurisprudence mettra un terme définitif au déploiement d’une activité aurifère sur le bassin du Kourou.

This Thursday, December 12, the Cayenne Administrative Court deliberated on the merits of the Nelson file. The prefectural decree authorizing SAS TRAJAN to operate an artisanal mine on the upper Kourou River has been declared illegal. Tourism operators, the TE'LEYU Native American Association and the French Guiana Nature Environnement federation are pleased to see the environmental laws apply today after more than a year of legal battle.

At the end of 2018, SAS TRAJAN had been authorized to operate a gold mine upstream of Kourou. Tourist operators, the Amerindian association TE’LEYU and the Guyana Nature Environment federation, however, challenged the legality of this act for non-compliance with environmental regulations. The applicants having been dismissed on the appeal in urgency early 2019, the mining company had been able to carry out its exploitation.

On Thursday, November 21, 2019, the applicants were able to speak on the merits of the case. On the one hand, the NFB, as the manager of state land, had given an unfavorable opinion questioning the sensitivity of the natural environments concerned. On the other hand, the environmental impact record was clearly insufficient with regard to the issues. This is what was retained by the Administrative Court of Cayenne this Thursday, December 12.

The Kourou basin is a living space rich in biodiversity. It is today an ecotourism showcase incompatible with gold mining. The legal mine located upstream of the river weakens Amazon ecosystems and cannot rely on environmental laws in the same way as any other economic activity. This is what confirms today's decision.

For Rémi GIRAULT, President of Guyane Nature Environnement, "it is an important decision that shows that this file was not properly instructed. Unfortunately, this mine, which has been exploited for several months, has generated irreversible environmental impacts and no revegetation technique can reconstruct the complexity of an old forest or a destroyed watercourse. Unstructured soils will still be subject to erosion for a long time and will continue to pollute the Kourou. "

Although the mine could not be stopped in time, the applicants are satisfied today with this decision and hope that this jurisprudence will put a definitive end to the deployment of a gold activity in the Kourou basin.
