L’enquête publique de la Centrale du Larivot d'EDF doit-elle être reportée ?

Alors que la majorité des enquêtes publiques ont été suspendues pour cause de confinement, la Préfecture de Guyane vient de décider le maintien de l’enquête publique de la Centrale thermique du Larivot du 20 avril au 20 mai de manière dématérialisée uniquement. La participation du public est un droit constitutionnel qui ne peut être exercé en période de confinement. La fédération Guyane Nature Environnement demande le report de cette enquête.

La ministre de la Transition écologique annonçait le 27 mars la suspension des enquêtes publiques en cours et le report de celle à venir durant la période de confinement. Cependant, une ordonnance du 25 mars relative à l’adaptation des procédures administratives pendant la période d’urgence sanitaire autorise la poursuite des enquêtes pour certains projets. Pour cela, trois conditions doivent être remplies : l’intérêt national, le caractère d’urgence et le fait que le retard lié à l’interruption de l’enquête est « susceptible d’entraîner des conséquences difficilement réparables ».

C’est en vertu de cette ordonnance que la Préfecture de Guyane a autorisé la mise en place de l’enquête publique sur la centrale thermique du Larivot de EDF du 20 avril au 20 mai en version dématérialisée uniquement, pour une période plus courte que prévue initialement.

Pourtant, une enquête publique doit pouvoir permettre aux citoyens de rencontrer un commissaire enquêteur ou de participer à des réunions publiques sur le projet afin de bien s’informer sur des dossiers ayant une incidence forte sur l’environnement. Une seule consultation électronique conduit à accroître l’iniquité des citoyens face à la fracture numérique.

Rappelons que ce projet vise à remplacer la centrale de Dégrad-des-Cannes par une centrale thermique au fioul de 120MW et 10MW de solaire installés à l’entrée de Cayenne, sur 20 ha de forêt marécageuse et de mangroves, ainsi qu’un oléoduc de 14km traversant l’Île de Cayenne. Le CNPN a par ailleurs rendu un avis défavorable et l’Autorité environnementale a relevé pas moins d’une trentaine d’insuffisances sur cette installation, ce qui montre le nombre d’interrogations que peut susciter un tel projet.

« Ce dossier est bien trop important pour que les guyanais soient consultés de la sorte, d’autant que nous aurions dû avoir un débat public sur cette centrale thermique au regard de son envergure. En quoi ce projet souvent remis en question est-il soudainement urgent ? En quoi est-il d’intérêt national alors qu’il va à l’encontre de l’Accord de Paris sur le climat ? En quoi son retardement est-il susceptible d’entraîner des conséquences irréparables alors que les alternatives possibles n’ont jamais réellement été discutées ? » s’indigne Rémi GIRAULT, Président de Guyane Nature Environnement.

Par le maintien de cette enquête, les citoyens seraient privés d’un exercice démocratique sur un dossier majeur pour le climat. La fédération Guyane Nature Environnement demande un report de cette enquête publique considérant que la commission d’enquête n’est pas à même de mener cette consultation dans le respect des exigences constitutionnelles.

While the majority of public inquiries have been suspended due to confinement, the Prefecture of Guyana has just decided to maintain the public inquiry of the Larivot Thermal Power Plant from April 20 to May 20 in a paperless manner only. Public participation is a constitutional right that cannot be exercised during confinement. The French Guyana Nature Environment Federation requests the postponement of this investigation.

The Minister for the Ecological Transition announced on March 27 the suspension of the current public inquiries and the postponement of the one to come during the confinement period. However, an ordinance of March 25 relating to the adaptation of administrative procedures during the health emergency period authorizes the continuation of investigations for certain projects. To do this, three conditions must be met: national interest, urgency and the fact that the delay linked to the interruption of the investigation is "likely to have consequences that are difficult to repair".

It is by virtue of this ordinance that the Prefecture of French Guiana authorized the setting up of the public inquiry on the Larivot thermal power station of EDF from April 20 to May 20 in dematerialized version only, for a shorter period than originally planned.

However, a public inquiry must be able to allow citizens to meet with an investigative commissioner or to participate in public meetings on the project in order to be properly informed about files having a strong impact on the environment. A single electronic consultation leads to increasing the inequity of citizens in the face of the digital divide.

Recall that this project aims to replace the Dégrad-des-Cannes power plant with a 120MW fuel oil thermal power plant and 10MW solar installed at the entrance of Cayenne, on 20 ha of swamp forest and mangroves, as well as an oil pipeline of 14km crossing the Cayenne Island. The CNPN also issued an unfavorable opinion and the Environmental Authority noted no less than thirty shortcomings in this installation, which shows the number of questions that such a project may raise.

"This case is far too important for Guianese people to be consulted in this way, especially since we should have had a public debate on this thermal power plant in view of its size. Why is this often questioned project suddenly urgent? How is it of national interest as it goes against the Paris Climate Agreement? How is its delay likely to lead to irreparable consequences when the possible alternatives have never really been discussed ?" Said Rémi GIRAULT, President of French Guiana Nature Environnement.

By maintaining this survey, citizens would be deprived of a democratic exercise on a major issue for the climate. The French Guiana Nature Environment Federation requests a postponement of this public inquiry, considering that the commission of inquiry is not in a position to conduct this consultation in compliance with constitutional requirements.
