Lors des élections municipales qui se tiendront les 18 et 25 octobre prochains, l'électeur (mandant) ne pouvant pas exercer personnellement son droit de vote le jour du scrutin peut le confier à un électeur de son choix (mandataire) qui votera à sa place.

Ce scrutin étant nouveau, les procurations établies pour le scrutin du mois de mars ne sont plus valables sauf si elles ont été expressément établies pour un an (trois ans si le mandant est établi à l'étranger) et qu'elles couvrent la date du scrutin. Ainsi les personnes de nouveau empêchées et ayant déjà fait une procuration en mars doivent refaire une nouvelle procuration.

Par ailleurs, exceptionnellement, en raison de la crise sanitaire de la Covid-19, chaque mandataire peut recevoir deux procurations, y compris si elles sont toutes deux établies en France.

Ces procurations doivent être établies auprès d'un tribunal judiciaire, d'un commissariat ou d'une gendarmerie en Guyane ou de tout autre département français, ou auprès d'une ambassade ou d'un consulat général de France à l'étranger. Elles sont établies pour les deux tours d'un seul scrutin sauf si le mandant limite expressément la procuration à un seul tour.

Le mandataire doit jouir de ses droits électoraux et être inscrit dans la même commune que le mandant. En revanche, il n'y a pas d'obligation à être électeur dans le même bureau de vote.

During the municipal elections to be held on October 18 and 25, the voter (principal) who cannot personally exercise his right to vote on polling day can entrust it to a voter of his choice (proxy) who will vote in his place. As this ballot is new, the proxies established for the March election are no longer valid unless they have been expressly established for one year (three years if the principal is established abroad) and cover the date of the election. Thus, people who are unable to attend again and who have already issued a proxy in March must make a new proxy.

In addition, exceptionally, due to the Covid-19 health crisis, each representative may receive two proxies, including if they are both established in France.

These proxies must be established with a judicial tribunal, a police station or a gendarmerie in French Guiana or any other French department, or with a French embassy or consulate general abroad. They are established for the two rounds of a single ballot unless the principal expressly limits the proxy to one round.

The representative must enjoy his electoral rights and be registered in the same municipality as the principal. On the other hand, there is no obligation to be a voter in the same polling station.
