Montagne d’Or : audience capitale au Tribunal administratif de Cayenne

Alors qu’en mai 2019 le gouvernement annonçait son opposition au projet Montagne d’Or, la compagnie Montagne d’Or attaquait en justice la décision implicite de rejet du renouvellement des concessions minières devant le juge administratif de Cayenne. Cette décision très attendue aura un impact direct sur le projet de méga-mine d’or mené par le consortium russo-canadien. L’association Guyane Nature Environnement est intervenante volontaire dans ce procès en soutien à l’Etat afin d’espérer enterrer définitivement ce projet controversé.

Fin 2017, la Compagnie Montagne d’Or présentait pour la première fois son projet de méga-mine à ciel ouvert entre deux réserves biologiques intégrales, en pleine forêt guyanaise. Le débat public organisé en 2018 a alors montré une vive opposition des guyanais à ce projet, notamment en raison des risques que faisaient encourir une telle infrastructure sur la population et les milieux naturels (utilisation de cyanure et d’explosifs, stockage de résidus, création de route, surconsommation en eau...).

A la sortie du Conseil de défense écologique en mai 2019, le gouvernement annonçait son opposition au projet « en l’état ». Or, à la surprise générale le 16 octobre 2019, la Préfecture de Guyane a inscrit le renouvellement pour 25 ans des concessions Montagne d’Or à l’ordre du jour de la commission des mines avec avis favorable des services de l’Etat. Pour que ce projet voit le jour, la multinationale avait effectivement dû solliciter en parallèle le renouvellement de ses concessions minières arrivées à expiration fin 2018. Si ce renouvellement n’autorise pas directement l’exploitation industrielle, elle permet à la société de continuer ses travaux de recherche et de déposer un projet de méga-mine ces 25 prochaines années, comme elle semble l’envisager.

Au même moment, nous apprenions l’existence d’un contentieux entre la société minière et l’Etat. En effet, l’Etat a implicitement rejeté cette demande par l’écoulement du délai réglementaire d’instruction, entretenant au passage la confusion sur la position gouvernementale. La multinationale a alors attaqué devant le tribunal administratif de Cayenne cette décision tout en réclamant un renouvellement rapide.

Ce jeudi 03 décembre à 9h, cette affaire sera jugée au fond. Ce contentieux est l’opportunité d’enterrer définitivement le «projet Montagne d’Or». L’association Guyane Nature Environnement, intervenante volontaire au procès, espère ainsi convaincre les juges de l’absurdité d’un tel renouvellement en apportant des éléments factuels.

While in May 2019 the government announced its opposition to the Golden Mountain project, the company was suing the implicit decision rejecting the renewal of mining concessions before the administrative judge in Cayenne. This long-awaited decision will have a direct impact on the mega-gold mine project led by the Russian-Canadian consortium. The Guyane Nature Environnement association volunteered to intervene in this lawsuit in support of the state in order to hope to definitively bury this controversial project.

At the end of 2017, the Golden Mountain Company presented for the first time its open-pit mega-mine project between two integral biological reserves, in the middle of the Guianese forest. The public debate organized in 2018 then showed strong opposition from Guianese people to this project, in particular because of the risks that such an infrastructure posed for the population and natural environments (use of cyanide and explosives, storage of residues, creation of road, overconsumption of water ...).

When the Ecological Defense Council left in May 2019, the government announced its opposition to the project "as is". However, to everyone's surprise on October 16, 2019, the Prefecture of French Guiana included the 25-year renewal of the Golden Mountain concessions on the agenda of the mining commission with a favorable opinion from the state services. For this project to see the light of day, the multinational actually had to apply in parallel for the renewal of its mining concessions which expired at the end of 2018. While this renewal does not directly authorize industrial exploitation, it allows the company to continue its work. research and file a mega-mine project for the next 25 years, as she seems to envision.

At the same time, we learned of the existence of a dispute between the mining company and the state. Indeed, the state implicitly rejected this request by the expiration of the regulatory period of investigation, in the process fueling confusion over the government's position. The multinational then appealed this decision to the Cayenne Administrative Court while demanding a rapid renewal.

This Thursday December 3 at 9am, this case will be judged on the merits. This litigation is the opportunity to definitively bury the "Golden Mountain project". The Guyane Nature Environnement association, a voluntary contributor to the trial, hopes to convince the judges of the absurdity of such a renewal by providing factual elements.
