La ligne aérienne Cayenne-Camopi bientôt ouverte

Le Tribunal Administratif (TA) de Guyane a rejeté hier le recours déposé par la Société Air CM Global, représentée par Madame Katia Penault, contre l’attribution de la Délégation de Service Public Air Guyane. Le tribunal a en effet confirmé que la signature du contrat et l’information préalable des parties (y compris la société requérante) a été effectuée de manière conforme par la Collectivité et que de ce fait, le recours en référé précontractuel n’est pas recevable.

La Collectivité Territoriale de Guyane se félicite de cette décision qui vient confirmer l rigueur de sa procédure. Elle regrette ces manœuvres dilatoires qui ont retardé de près de trois mois la desserte de l’Est Guyanais, alors que :

▪ d’une part les écarts financiers et techniques entre les différents postulants à la Délégation étaient nets
▪ d’autre part des doutes importants sont apparus en cours de procédure sur la réelle implication de la société Air CM Global aux côtés de Mme Penault et sur la viabilité du montage administratif et juridique complexe et peu clair proposé par ce candidat.

A ce titre le PDG de la société Air CM Global a personnellement confirmé courant février 2021 à la Collectivité avoir stoppé ses activités en Guyane au début de l’été et ne pas avoir mandaté Mme Penault pour déposer un référé au nom de la société. Rien ne s’oppose donc aujourd’hui à la mise en œuvre de la délégation de Service Public.

La CTG, dans un souci de faire démarrer le plus rapidement possible ce nouveau système de desserte indispensable aux habitants de la Guyane, œuvre maintenant avec la société Air Guyane pour une mise en route rapide, dès avril, de la nouvelle Délégation de Service Public et notamment de la nouvelle liaison avec Camopi.

The Administrative Court (TA) of French Guiana yesterday rejected the appeal filed by Air CM Global, represented by Ms. Katia Penault, against the attribution of the Air Guyane Public Service Delegation. The court confirmed that the signing of the contract and the prior information of the parties (including the applicant company) was carried out in a compliant manner by the Collectivity and that therefore, the pre-contractual summary appeal is not admissible. .

The Territorial Collectivity of French Guiana welcomes this decision which confirms the rigor of its procedure. She regrets these delaying tactics which delayed service to Eastern French Guiana by almost three months, when:

▪ on the one hand, the financial and technical differences between the different applicants to the Delegation were clear
▪ on the other hand, significant doubts arose during the proceedings on the real involvement of Air CM Global alongside Ms. Penault and on the viability of the complex and unclear administrative and legal arrangement proposed by this candidate.

As such, the CEO of the company Air CM Global personally confirmed in February 2021 to the Collectivity that he had stopped its activities in French Guiana at the beginning of the summer and that he had not mandated Ms. Penault to file a summary in the name of the company. Nothing therefore stands today against the implementation of the delegation of Public Service.

The CTG, in order to start as quickly as possible this new service system essential to the inhabitants of French Guiana, is now working with the company Air Guyane for a rapid start-up, from April, of the new Public Service Delegation. and in particular the new link with Camopi.
