Montagne d'or: la commission des mines dit non au renouvellement des concessions

Ce matin, la commission départementale des mines a voté en majorité contre le renouvellement des concessions de la société Montagne d’or à Saint Laurent du Maroni et Apatou. La question du renouvellement des concessions minières, première étape avant l’instruction de leur projet de méga-mine industrielle, avait déjà été posée à la commission des mines en 2019, laquelle avait donné le 29 avril 2020 un avis favorable. Le revirement de la position de la commission des mines témoigne d’une avancée notable dans la prise en compte de l’environnement dans les projets miniers, qui devra se poursuivre.

Une avancée dans la prise en compte de l’environnement
L’avis défavorable porte sur le renouvellement de deux concessions historiques de la compagnie Montagne d’or, Boeuf-Mort et Elysée, qui étaient arrivées à échéance le 31 décembre 2018. Le renouvellement de ces concessions minières est la première étape avant de pouvoir mettre en place le projet de méga-mine industrielle qui a fait l’objet d’une forte opposition des citoyens, notamment des peuples autochtones, lors du débat public en 2018. Pour mémoire, ce projet visait à créer une mine à ciel ouvert d’au moins 2,5 km de long sur 400m de large et plus d’une centaine de mètres de profondeur et à traiter le minerais au cyanure, en bordure de la Réserve Biologique Intégrale de Lucifer Dékou-Dékou, la plus grande de France.

Les concessions se trouvent sur un site exceptionnel en termes de biodiversité, un corridor écologique recensant plus d’une centaine d’espèces remarquables et un tiers des espèces d’oiseaux présentes en Guyane. La déforestation engendrée, l’impact sur les cours d’eau et les risques industriels liés au cyanure, aux autres matières dangereuses, aux tirs de mine, à la rupture de digues et au lessivage des sols ne sont pas acceptables dans un environnement aussi exceptionnel.

Après avoir refusé implicitement le renouvellement des concessions, l’Etat s’était faiblement défendu devant le Tribunal administratif de Cayenne, qui a considéré le refus de renouvellement contraire au code minier. L’Etat avait fait appel de cette décision devant la Cour administrative d’appel de Bordeaux, qui avait conclu dans le même sens. L’Etat a de nouveau contesté cette décision devant le Conseil d’Etat. Le Conseil d’Etat a d’ailleurs demandé au Conseil constitutionnel si le code minier était conforme à la Constitution, dans le cadre d’un recours formé par France Nature Environnement sur les concessions Boulanger.

Dans le même temps, les parlementaires ont acté que l’on pourrait refuser un projet minier si son impact environnemental était trop élevé, dans le cadre de la loi Climat et résilience. Le changement de la position de la commission des mines semble donc emprunter la même direction d’une meilleure prise en compte de l’environnement dans l’instruction des projets miniers.

Maintenant, une position à tenir malgré la pression
Le projet de Montagne d’or n’est pas enterré pour autant. En effet, l’avis défavorable de la commission des mines est un avis simple et le Ministère de l’économie pourrait ne pas en tenir compte et renouveler ces concessions. De plus, la France est actuellement visée par un contentieux arbitral international par les actionnaires russes de Montagne d’or sur le non-renouvellement des concessions, réclamant 4 milliards d’euros d’indemnités à l’Etat. En outre, la société Orea Mining, l’autre actionnaire de Montagne d’or, a annoncé le 1er septembre dernier vouloir revenir avec un projet modifié soit-disant plus vert, à la veille de l’ouverture du Congrès Mondial de la nature, marquant leur volonté de ne pas abandonner.

Renouveler les concessions Montagne d’or serait contraire à l’avis défavorable exprimé par les citoyens lors du débat public, à la Charte de l’environnement à valeur constitutionnelle, ainsi qu’au droit européen, qui protège les cours d’eau en bon état de toute dégradation. Guyane Nature Environnement espère donc que l’Etat ne cédera pas à la pression et sera constant dans son refus du renouvellement des concessions et du projet de Montagne d’or.

The renewal of these mining concessions is the first step before being able to put in place the industrial mega-mine project which was the subject of strong opposition from citizens, especially indigenous peoples, during the public debate in 2018. As a reminder, this project aimed to create an open-cast mine of at least 2.5 km long by 400m wide and more than a hundred meters deep and to treat the ore with cyanide, on the edge of the Integral Biological Reserve of Lucifer Dékou-Dékou, the largest in France.

The concessions are located on an exceptional site in terms of biodiversity, an ecological corridor listing more than a hundred remarkable species and a third of the bird species present in French Guiana. The deforestation generated, the impact on watercourses and the industrial risks linked to cyanide, other hazardous materials, blasting, breaking of dikes and leaching of soils are not acceptable in such an exceptional environment. .

After implicitly refusing the renewal of the concessions, the state had weakly defended itself before the Cayenne Administrative Court, which considered the refusal to renew contrary to the mining code. The state appealed against this decision to the Bordeaux Administrative Court of Appeal, which concluded in the same direction. The state again challenged this decision before the Council of State. The Council of State has also asked the Constitutional Council whether the mining code complies with the Constitution, in the context of an appeal filed by France Nature Environnement on the Boulanger concessions.

At the same time, parliamentarians noted that a mining project could be refused if its environmental impact was too high, within the framework of the Climate and Resilience Act. The change in the position of the mining commission therefore seems to be heading in the same direction of better taking into account the environment in the examination of mining projects.

Now a position to hold despite the pressure
The Gold Mountain project is not completely buried, however. Indeed, the negative opinion of the mining commission is a simple opinion and the Ministry of the Economy could ignore it and renew these concessions. In addition, France is currently the subject of an international arbitration dispute by the Russian shareholders of Montagne d´or over the non-renewal of the concessions, demanding 4 billion euros in compensation from the state. In addition, the company Orea Mining, the other shareholder of Montagne d'or, announced on September 1 that it wanted to come back with a modified project, supposedly greener, on the eve of the opening of the World Conservation Congress, marking their will not to give up.

Renewing the Montagne d'Or concessions would be contrary to the unfavorable opinion expressed by citizens during the public debate, to the Environmental Charter with constitutional value, as well as to European law, which protects waterways in good condition. state of any degradation. Guyane Nature Environnement therefore hopes that the State will not give in to the pressure and will be steadfast in its refusal to renew the concessions and the Montagne d´or project.
