Victoire historique pour l’environnement devant le Conseil Constitutionnel

Saisi par France Nature Environnement et Guyane Nature Environnement, le Conseil constitutionnel déclare plusieurs articles du code minier contraires à la charte de l’environnement. Cette décision historique est de nature à justifier le refus du projet dit “Montagne d’or” en Guyane, alors que le gouvernement peinait depuis plusieurs années à s’y opposer concrètement. Elle est également historique car pour la première fois, deux articles de la Charte de l'Environnement sont appliqués, avec des conséquences potentiellement extrêmement fortes sur le droit de l’environnement. Une décision historique du Conseil Constitutionnel
Le Conseil constitutionnel considère qu’un octroi ou un renouvellement de concession minière peut être refusé en raison de l’impact environnemental du projet. Il répondait à une question prioritaire de constitutionnalité (QPC) posée par France Nature Environnement et Guyane Nature Environnement, après le renouvellement de 4 concessions minières de la Compagnie Minière de Boulanger en Guyane. La question prioritaire de constitutionnalité portait sur la compatibilité de certains articles du Code minier, qui autorisent l’Etat à délivrer une concession minière sans tenir compte de l'environnement, avec la charte constitutionnelle de l'environnement .

«C’est la première fois que le Conseil Constitutionnel fait application des articles 1 et 3 de la Charte de l’environnement qui garantit le “droit de vivre dans un environnement sain et équilibré”. 17 ans après l’entrée en vigueur de la charte, c’est une décision vraiment majeure pour le droit de l’environnement ! » remarque Raymond Léost, administrateur et responsable du réseau juridique de FNE.

Une jurisprudence essentielle qui aura des conséquences majeures au-delà même des projets miniers en France: une administration doit pouvoir dire non à tout projet attentatoire à l’environnement.

Un coup d’arrêt à la contestée Montagne d’or en Guyane
La compagnie minière Montagne d’or souhaitait développer un projet de mine industrielle extrayant l’or grâce au cyanure en creusant une fosse de 2,5 km de long en limite de Réserve biologique intégrale, au cœur de la forêt guyanaise.

Au-delà du cas Boulanger, la décision rendue aujourd’hui par le Conseil constitutionnel pourrait également légitimer le refus de l’Etat de renouveler les concessions Montagne d’or. Jusqu’à maintenant, le tribunal administratif de Cayenne suivi par la cour administrative d’appel de Bordeaux ont jugé que le refus de l’Etat de renouveler ces concessions pour le projet Montagne d’or était illégal, malgré les annonces politiques du gouvernement depuis 2019.

«Cette décision est de nature à mettre un point final au projet “Montagne d’or” grâce aux associations. C’est une excellente nouvelle historique pour la biodiversité guyanaise et on espère que cela appellera à une grande vigilance sur les futurs projets miniers.» résume Matthieu Barthas, vice-président de Guyane Nature Environnement.

This historic decision is likely to justify the refusal of the so-called “Golden Mountain” project in French Guiana, while the government had been struggling for several years to concretely oppose it. A historic decision of the Constitutional Council
The Constitutional Council considers that the granting or renewal of a mining concession may be refused because of the environmental impact of the project. It answered a priority question of constitutionality (QPC) posed by France Nature Environnement and Guyane Nature Environnement, after the renewal of 4 mining concessions of the Boulanger Mining Company in French Guiana. The priority question of constitutionality concerned the compatibility of certain articles of the Mining Code, which authorize the State to issue a mining concession without taking the environment into account, with the constitutional charter of the environment.

“This is the first time that the Constitutional Council has applied Articles 1 and 3 of the Environmental Charter which guarantees the “right to live in a healthy and balanced environment”. 17 years after the entry into force of the charter, this is a truly major decision for environmental law! ” remarks Raymond Léost, administrator and head of the FNE legal network.

An essential case law that will have major consequences even beyond mining projects in France: an administration must be able to say no to any project that is harmful to the environment.

A halt to the disputed Golden Mountain in French Guiana
The Golden Mountain mining company wanted to develop an industrial mine project extracting gold using cyanide by digging a 2.5 km long pit on the edge of the Integral Biological Reserve, in the heart of the Guianese forest.

Beyond the Boulanger case, the decision rendered today by the Constitutional Council could also legitimize the State's refusal to renew the Montagne d'Or concessions. Until now, the administrative court of Cayenne followed by the administrative court of appeal of Bordeaux judged that the refusal of the State to renew these concessions for the Montagne d'or project was illegal, in spite of the political announcements of the government since 2019.

“This decision is likely to put an end to the “Montagne d’or” project thanks to the associations. This is excellent historic news for Guianese biodiversity and we hope that it will call for great vigilance on future mining projects.” summarizes Matthieu Barthas, vice-president of Guyane Nature Environnement.
