Pollution de Gold’or: la société d’orpaillage condamnée en appel

Le 24 février 2022, la Cour d’appel de Cayenne a confirmé le jugement de première instance condamnant la société d’orpaillage Gold’or pour pollution aux matières en suspension dans la crique Kokioko. La société est toujours condamnée à une amende de 100 000 euros avec sursis ainsi qu’au versement de 10 000 euros de dommages et intérêts pour les différentes parties civiles, l’Office National des Forêts, France Nature Environnement et Guyane Nature Environnement. Retour sur l’affaire.

La confirmation d’une condamnation historique en Guyane

Pour rappel, en juillet 2018, les agents de l’ONF ont constaté une pollution record au niveau de la crique Kokioko, sur la commune de Mana, où se situe une mine d’or artisanale détenue par la société GOLD’OR gérée par la famille Ostorero. Une eau boueuse et opaque était déversée dans la crique, à la suite de l’ouverture d’une barranque. La turbidité alors mesurée excédait la capacité des appareils de mesure, signe d’une très sérieuse pollution.

La Cour d’appel de Cayenne a confirmé la sanction de 100 000 euros d’amende, avec sursis, et 1 euro symbolique au titre du préjudice écologique, une première en Guyane. Il lui a été notamment reproché le fait d’avoir volontairement ouvert les digues, pour rapidement aller exploiter un autre site, engendrant un déversement important de boue dans le cours d’eau, asphyxiant ainsi les organismes vivants présents. Cette pollution aurait clairement pu être évitée, si la saisonnalité des travaux et le temps de séchage des barranques avaient été respectés.

Face à cette pollution massive constatée sur plusieurs kilomètres, les associations de protection de l’environnement en appelaient à un respect strict de la réglementation en vigueur et se sont donc constituées parties civiles. Elles ont pu obtenir réparation du préjudice subi, à l’instar de l’ONF également partie civile au procès.

La décision invite plus que jamais à la vigilance sur la gestion des sites miniers

La confirmation de cette condamnation est d’autant plus importante qu’elle met en relief la négligence vis-à-vis de la protection de l’environnement dont peuvent faire preuve les gérants de cette société, la famille Ostorero. En effet, l’une des personnes gérant la société Gold’or n’est autre que la présidente de la Fédération des Opérateurs Miniers de Guyane, la FEDOMG, qui par cette condamnation, la seule du genre en Guyane, est loin de montrer l’exemple d’une mine responsable. La famille Ostorero est également à l’origine de nombreux projets miniers, comme le projet Espérance avec une de leurs autres sociétés minières: ce dernier projet s’apparente à un projet Montagne d’or bis et requiert une extrême vigilance vis- à-vis des risques industriels et environnementaux.

« La confirmation de ce jugement en appel est un signal fort, qui invite à la plus grande prudence quant au respect des normes environnementales dans le secteur minier. A l’avenir, face à une telle négligence, on doute fortement de la capacité de ces gérants à exploiter une mine industrielle sans risque. » déclare Garance LECOCQ, coordinatrice de Guyane Nature Environnement.

Les associations se félicitent de la confirmation en appel d’une telle décision, qui reste historique en matière d’extraction aurifère en Guyane et espère que celle-ci restera dissuasive vis-à-vis des risques que font encourir une telle activité sur les milieux naturels en Amazonie.

Confirmation of a landmark conviction in French Guiana

As a reminder, in July 2018, ONF agents observed record pollution at Kokioko creek, in the town of Mana, where an artisanal gold mine is located, owned by the GOLD'OR company managed by the Ostorero family. Muddy and opaque water was poured into the creek, following the opening of a barranque. The turbidity then measured exceeded the capacity of the measuring devices, a sign of very serious pollution.

The Cayenne Court of Appeal confirmed the penalty of a fine of 100,000 euros, suspended, and a symbolic 1 euro for ecological damage, a first in French Guiana. He was particularly accused of having voluntarily opened the dikes, to quickly go to exploit another site, causing a major spill of mud in the watercourse, thus asphyxiating the living organisms present. This pollution could clearly have been avoided, if the seasonality of the works and the drying time of the barranques had been respected.

Faced with this massive pollution observed over several kilometres, environmental protection associations called for strict compliance with the regulations in force and therefore filed civil suits. They were able to obtain compensation for the damage suffered, like the ONF, which was also a civil party to the trial.

The decision calls more than ever for vigilance on the management of mining sites

The confirmation of this condemnation is all the more important as it highlights the negligence vis-à-vis the protection of the environment that the managers of this company, the Ostorero family, may show. Indeed, one of the people managing the company Gold'or is none other than the president of the Federation of Mining Operators of French Guiana, the FEDOMG, which by this condemnation, the only one of its kind in French Guiana, is far from set an example of responsible mining. The Ostorero family is also at the origin of many mining projects, such as the Espérance project with one of their other mining companies: this last project is similar to a Montagne d'or bis project and requires extreme vigilance vis-à-vis industrial and environmental risks.

“The confirmation of this judgment on appeal is a strong signal, which calls for the greatest caution with regard to compliance with environmental standards in the mining sector. In the future, faced with such negligence, we strongly doubt the ability of these managers to operate an industrial mine without risk." says Garance LECOCQ, coordinator of Guyane Nature Environnement.

The associations welcome the confirmation on appeal of such a decision, which remains historic in terms of gold mining in French Guiana and hopes that it will remain a deterrent to the risks that such an activity entails on the natural environments in the Amazon.
